Terms of Service

These Terms of Service ("Terms") govern your access to and use of GrowthCrank's services. By signing up, paying for any plan, or using our services, you ("Client," "you") agree to these Terms.
1. The Service
GrowthCrank provides AI-powered lead generation services that deliver guaranteed qualified appointments to businesses. We:
- Build and deploy AI-driven outreach campaigns targeting prospects in your declared market;
- Identify, contact, and qualify prospective customers on your behalf;
- Schedule qualified appointments directly onto your calendar;
- Provide reporting, analytics, and ongoing campaign optimization.
We deliver qualified appointments. We do not perform the services your business provides. You serve the appointments we deliver.
2. Plans and Pricing
2.1 Growth Plan — $1,997/mo
- AI-powered lead generation and appointment setting;
- Month-to-month, no minimum term;
- Performance guarantee: 8 qualified appointments in 30 days of full operation or next month free (see Refund Policy).
2.2 Scale Plan — $4,997/mo
- Everything in Growth, plus expanded campaign volume, additional channels, and priority optimization;
- Month-to-month, no minimum term;
- Performance guarantee applies with scaled appointment targets as documented in your order confirmation.
2.3 Dominate Plan — $9,997/mo
- Everything in Scale, plus dedicated campaign management, multi-market expansion, and custom integrations;
- Month-to-month, no minimum term;
- Performance guarantee applies with scaled appointment targets as documented in your order confirmation.
2.4 General Pricing Terms
- All plans are billed monthly via Stripe. No setup fees unless separately agreed.
- Pricing is exclusive of applicable sales tax, VAT, or similar tax. Where required by law, taxes are added at checkout.
- We reserve the right to change pricing for new subscribers. Active subscribers retain their current rate as long as their subscription remains continuously active.
3. Billing and Cancellation
Month-to-month. All plans are month-to-month with no long-term contract or commitment.
Cancel anytime. You may cancel by emailing support@growthcrank.com with "Cancel" in the subject line.
Cancellation ends your subscription at the end of the current billing period. You retain full service through the period you've already paid for. We do not pro-rate or refund partial months.
We may cancel your subscription at any time for cause (Section 8) or at the end of a billing period for convenience, with at least 7 days' notice.
4. The 8-Appointment Guarantee
Our performance guarantee is documented in full in our Refund Policy and is incorporated into these Terms by reference. In summary:
- If we deliver fewer than 8 qualified appointments within 30 consecutive days of full operation, your next month of service is free.
- This is not a cash refund — it is a complimentary month of continued service at no charge.

5. Definition of "Full Operation"
"Full operation" means the GrowthCrank system has been actively running your approved campaign for 30 consecutive calendar days without interruption caused by:
- Client-requested pauses or changes that halt outreach;
- Failure by Client to complete onboarding within a reasonable timeframe;
- Failure by Client to approve campaign materials when requested;
- Account suspension due to non-payment or breach of these Terms.
The 30-day clock starts on the date we activate your approved campaign and notify you in writing (email). If you request a pause, the clock resets when the campaign resumes.
6. Definition of "Qualified Appointment"
A "qualified appointment" means a scheduled meeting or call with a unique prospect who:
- (a) Is within your declared target market or service area;
- (b) Has expressed interest in the type of service you provide;
- (c) Has confirmed a specific date and time to speak with you or your team;
- (d) Has provided verified contact information (phone number or email);
- (e) Was not on any exclusion list you provided during onboarding.
What does NOT disqualify an appointment: A prospect who no-shows, reschedules, or ultimately decides not to buy still counts as a qualified appointment if criteria (a)–(e) were met at the time of scheduling. We deliver appointments, not closed deals.
What DOES disqualify an appointment: Duplicates (same person scheduled twice), prospects outside your target market, fake or invalid contact information, or contacts from your exclusion list.
7. Your Responsibilities
To get value from the service, you must:
- Complete onboarding within 7 business days of subscribing (provide target market info, service descriptions, calendar access, and any exclusion lists);
- Review and approve campaign materials within 3 business days of receiving them;
- Show up to scheduled appointments or have a team member attend on your behalf;
- Maintain an active calendar integration so appointments can be booked;
- Comply with all laws applicable to your business when serving prospects we deliver;
- Not resell, redistribute, or share appointment leads delivered by GrowthCrank with any third party.
8. Acceptable Use
You agree not to:
- Use GrowthCrank to target prospects in jurisdictions where such outreach is unlawful;
- Direct GrowthCrank to send messaging that is deceptive, fraudulent, defamatory, or violates any law;
- Use GrowthCrank services for any business activity prohibited by Stripe or our outbound channel providers;
- Resell, sublicense, or white-label GrowthCrank's services without written agreement;
- Attempt to reverse-engineer, copy, or replicate our AI systems, workflows, or proprietary processes.
We may suspend or terminate service for any breach of this section with no further obligation.
9. Intellectual Property
- GrowthCrank retains ownership of all software, AI models, automations, sequences, campaign templates, and infrastructure used to deliver the service.
- You retain ownership of your business data, brand assets, customer lists, and the appointment leads we deliver to you.
- We retain a non-exclusive license to use anonymized, aggregated performance data for internal optimization. Case studies that name your business require your separate written consent.
10. Confidentiality
Each party agrees to keep the other's non-public information confidential. We will not disclose your business data, customer lists, or campaign details to any third party except as required by law or to operate the service.
11. Disclaimer
GrowthCrank delivers qualified appointments, not closed deals or revenue. We do not guarantee that a delivered appointment will convert into a paying customer — that depends on your sales process, pricing, and follow-up.
The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, GrowthCrank's total aggregate liability to you for any claim arising out of or related to these Terms or the service is limited to the total fees you paid GrowthCrank in the 3 months preceding the claim.
In no event will GrowthCrank be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business, or loss of goodwill, even if advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold GrowthCrank harmless from any third-party claim arising from (a) your conduct during appointments we deliver, (b) your business's actions when serving prospects, (c) your breach of these Terms, or (d) your violation of any law.
14. Modifications to the Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved by binding arbitration in Wyoming, except that either party may seek injunctive relief in any court of competent jurisdiction for misuse of intellectual property or confidential information.
